The general anti-avoidance rule replaces the common law approach. If it looks like a tax swerve, the taxman can call it so and ask for the tax due just like that. Even though tax swerving rather than evading is technically legal, exploiting loopholes hardly benefits society when it can only be accessed by the rich and wealthy.
